Sunway Money Sdn Bhd Privacy Policy

1. This Privacy Policy applies in relation to all information supplied by any person who registers to be a customer (the "Customer") of the international money remittance service and other services (the "Service") operated by Sunway Money Sdn Bhd ("Sunway"). Sunway Money Sdn Bhd is a part of the Sunway group of companies which includes all subsidiaries and affiliates of Sunway Berhad worldwide ("Sunway Group").
2. This Privacy Policy may be amended and/or supplemented from time to time without further notice or reference to the Customer. Sunway may (but not obliged to) notify the Customers of any changes to the Privacy Policy by notices places on Sunway's website. Continued participation in the Service will signify the Customer's agreement to the new (revised) Privacy Policy.
3. Sunway will collect information and document containing the Data Subject's name, NRIC/Passport number, email address, contact details, bank account information, Service usage / transaction history, computer IP address, mobile device geolocation and other numbers from and about the Customer's device (such as metadata including device properties, settings, applications, stored information and usage) and carrier, domain and host for connecting to the Internet, browser and operating system software the Customer uses, date and time the Customer access Sunway website or the Service, beneficiary information, transaction information, bank card detail amongst others when the Customer registers to the Service and/or use Sunway services (collectively, the "Personal Data"), directly from the owner of such Personal Data (the "Data Subject", including without limitation the Customer, persons privy to the Customer’s use of the Service such as the beneficiary of the remittance order) and/or from third party sources available to Sunway. Sunway will use and disclose the Personal Data for the following purposes :-
   1. To facilitate Sunway in the providing and delivery of any products and services to the Customer, including but not limited to carrying out transactions the Customer has requested (e.g. money transfers and loyalty services), and assisting us in improving and developing these services;
   2. To facilitate Sunway Group (including Sunway Fintech Services Sdn Bhd (formerly known as Sunway SCF Sdn Bhd)) in providing and delivery of any additional products and services to the Customer that are offered by Sunway Group to enhance Customer experience;
   3. For verification and identification of Customers, the general organisation and administration of the Customer's account, the information the Customer provides and to operate the Service generally;
   4. To communicate with the Customers from time to time (e.g. to inform the Customers of updates to this Privacy Policy or the Service's terms and conditions);
   5. To analyse Customers' activity and consumer behaviour to help improve Sunway's services to the Customers;
   6. To observe and comply with, and accordingly impose, Sunway's legal, regulatory, security and processing obligations and requirements, government and foreign government requirements applicable to Sunway, the Sunway Group, our affiliates and/or service providers, including but not limited to anti-money laundering and counter-terrorism laws and guidelines, in Malaysia and/or any jurisdiction as applicable;
   7. For advertising and promotional purposes in connection with the Service; and/or
   8. For advertising and publicity purposes connected with any promotion, sale or event conducted by Sunway and/or any customer of the Sunway Group.

4. Failure to provide compulsory information will render Sunway unable to provide the Customer the Service.
5. Data Subjects' Personal Data provided to Sunway may be disclosed or transferred within the Sunway Group or to Sunway's licensees, business partners, advisors, service providers and/or participating merchants in the Service, relevant authorities, within or outside Malaysia, for the fulfilment of the Purposes. Sunway will treat the Data Subjects' Personal Data as confidential and will not disclose or transfer the Personal Data to any other class of third parties except as specified herein unless if Sunway is under either a legal obligation or any other legal duty to do so.
6. The Personal Data provided to Sunway can be accessed via the Customer’s Service account at www.sunwaymoney.com, the Sunway Money mobile application (the "Service account") or via request in writing to Sunway as stated below. If there is any change in the Personal Data or if the Data Subject becomes aware of any errors in his/her Personal Data, please log in to your Service account to update or to correct such errors or notify us in writing immediately at the contact particulars set out herein below. If the Data Subject has any queries or complaints relating to the handling of his/her Personal Data, please contact Sunway at the particulars set out below. Sunway will address your queries, requests and/or complaints as soon as reasonably practicable.
7. The Data Subject may at any time request to limit the processing of the Data Subject's Personal Data, correction of the Personal Data of the Data Subject held by Sunway or delete his/her Service account. Such requests must be made in writing via email as set out below. Data Subject agrees that notwithstanding the aforesaid request, Sunway may process and/or retain Data Subject’s Personal Data to the extent required or otherwise permitted by applicable laws and regulations.

8. The Customer agrees that this Privacy Policy shall form part of the Terms and Conditions for the Service (the "Terms") and acceptance of the Terms shall constitute acceptance of this Privacy Policy.
9. The Customer shall be deemed to have procured the consent of any third-party individual (s) whose Personal Data have been disclosed to Sunway by the Customer for the Purposes and/or the Services, whichever applicable, to Sunway’s processing of the Personal Data in accordance with this Privacy Policy. In the event the Customer is a non-individual entity, the Personal Data disclosed to Sunway by the Customer for the Purposes and/or the Services, shall be deemed to have been lawfully provided where the appropriate consent to Sunway’s processing of Personal Data in accordance with this Privacy Policy have been provided by such Data Subject through the Customer.

The English version shall prevail in the event of any inconsistency with the Malay version.

Polisi Keperibadian Sunway Money Sdn Bhd

1. Polisi Keperibadian ini terpakai terhadap semua maklumat yang dibekalkan oleh mana-mana pihak yang berdaftar untuk menjadi seorang pelanggan ("Pelanggan" tersebut) perkhidmatan pengiriman wang antarabangsa dan lain-lain perkhidmatan ("Perkhidmatan" tersebut) yang dioperasi oleh Sunway Money Sdn Bhd ("Sunway"). Sunway Money Sdn Bhd adalah sebahagian kumpulan syarikat Sunway yang termasuk semua anak-anak syarikat dan sekutu Sunway Berhad di seluruh dunia ("Kumpulan Sunway").
2. Polisi Keperibadian ini akan dipinda dan/atau ditambah dari masa ke masa tanpa notis atau rujukan yang selanjutnya kepada Pelanggan. Sunway akan (tetapi tidak bertanggungjawab untuk) memaklumkan Pelanggan tentang apa-apa perubahan kepada Polisi Keperibadian melalui notis yang diterbitkan melalui laman web Sunway. Penglibatan yang berterusan dalam Perkhidmatan tersebut akan bermaksud perjanjian Pelanggan kepada Polisi Keperibadian baru (yang terpinda).
3. Sunway akan mengumpul maklumat dan dokumen mengandungi nama, No. Kad Pengenalan/Paspot, alamat emel, butiran perhubungan, maklumat bank akaun, penggunaan Perkhidmatan/rekod transaksi, alamat IP komputer, geolokasi peranti mudah alih dan lain-lain angka daripada dan berkenaan dengan peralatan Pelanggan (seperti metadata termasuk sifat-sifat, tetapan, perisian, maklumat yang tersimpan dan penggunaan peralatan) dan pengangkut, domain dan host untuk menyambung kepada Internet, pelayar web dan system pengoperasian perisian yang digunakan oleh Pelanggan, Tarikh dan masa Pelanggan mengakses laman web Sunway atau Perkhidmatan tersebut, maklumat penerima, maklumat transaksi, butir-butir kad bank Subjek Data antara lainnya apabila Pelanggan tersebut mendaftar bagi Perkhidmatan tersebut dan/atau menggunakan perkhidmatan Sunway (secara kolektifnya, "Data Peribadi" tersebut), secara terus daripada pemilik Data Peribadi tersebut ("Subjek Data" tersebut, termasuk tanpa had Pelanggan tersebut dan pihak-pihak yang terlibat dengan penggunaan perkhidmatan tersebut oleh Pelanggan seperti penerima pesanan pengiriman tersebut) dan/atau daripada sumber pihak ketiga yang kepada Sunway. Sunway akan mengguna dan menzahirkan Data Peribadi tersebut bagi tujuan-tujuan berikut:-
   1. Untuk menfasilitasi Sunway dalam pembekalan dan pelaksanaan apa-apa produk dan perkhidmatan kepada Pelanggan, termasuk tertapi tidak terhad kepada melaksanakan transaksi yang dipohon oleh Pelanggan (seperti pengiriman wang dan perkhidmatan ganjaran), dan membantu kami dalam menambahbaik dan membangunkan perkhidmatan sedemikian;
   2. Untuk memudahkan Kumpulan Sunway (termasuk Sunway Fintech Services Sdn Bhd (formerly known as Sunway SCF Sdn Bhd)) dalam pembekalan dan pelaksanaan sebarang produk dan perkhidmatan tambahan kepada Pelanggan yang ditawarkan oleh Kumpulan Sunway untuk meningkatkan pengalaman Pelanggan;
   3. Untuk pengesahan dan pengenalpastian identiti Pelanggan, pengurusan dan pentadbiran akaun Pelanggan, maklumat yang dibekalkan oleh Pelanggan dan pembekalan Perkhidmatan secara umum;
   4. Untuk berkomunikasi dengan Pelanggan dari masa ke masa (sebagai contohnya untuk memaklumkan Pelanggan pengemaskinian Polisi Keperibadian atau terma-terma dan syarat-syarat Perkhidmatan);
   5. Untuk menganalisasi aktiviti dan tingkah laku Pelanggan untuk membantu menambahbaik perkhidmatan Sunway bagi Pelanggan;
   6. Untuk mematuhi dan mengikuti, serta sedemikiannya melaksanakan, tanggungjawab dan keperluan perundangan, pengawalseliaan, keselamatan dan pemprosesan Sunway, keperluan kerajaan tempatan dan kerajaan asing yang terpakai terhadap Sunway, kumpulan Sunway, sekutu dan/atau penyedia perkhidmatan kami, termasuk dan tidak terhad kepada undang-undang dan panduan pencegahan pegubahan wang haram dan pencegahan kegiatan haram, di dalam Malaysia dan/atau mana-mana bidangkuasa yang terpakai;
   7. Untuk tujuan pengiklanan dan promosi berkenaan dengan Perkhidmatan tersebut; dan/atau
   8. Untuk tujuan pengiklanan dan publisiti berkaitan dengan apa-apa promosi, jualan atau acara yang diaturkan oleh Sunway dan/atau apa-apa pelanggan Sunway Group
      (secara kolektifnya, "Tujuan" tersebut)
4. Kegagalan untuk membekalkan maklumat yang wajib akan menyebabkan Sunway tidak dapat membekalkan Pelanggan Perkhidmatan tersebut.
5. Maklumat Peribadi Subjek Data yang dibekalkan kepada Sunway akan dizahirkan atau dipindah dalam kumpulan Sunway atau kepada pemegang lesen, rakan perniagaan, penasihat, penyedia perkhidmatan dan/atau peniaga yang terlibat dalam Perkhidmatan tersebut, pihak berkuatkuasa yang berkenaan, di dalam atau di luar Malaysia, untuk memenuhi Tujuan tersebut, Sunway akan menganggap maklumat peribadi Subjek Data sulit dan tidak akan menzahirkan atau memindahkan Data Peribadi kepada mana-mana kelas pihak ketiga kecuali sepertimana yang dinyatakan di sini melainkan bahawa jika Sunway adalah tertakluk kepada suatu kewajipan perundangan atau apa-apa tanggungjawab perundangan untuk melakukan sedemikian.
6. Data Peribadi yang dibekalkan kepada Sunway boleh diakses melalui akaun Perkhidmatan pelanggan di www.sunwaymoney.com, aplikasi mudah Sunway Money ("akaun Perkhidmatan" tersebut) atau melalui permintaan bertulis kepada Sunway seperti yang dinyatakan di bawah. Jika terdapatnya apa-apa perubahan dalam Data Peribadi atau jika Subjek Data adalah sedar terhadap apa-apa kesilapan dalam Data Peribadi beliau, sila log masuk ke dalam akaun Perkhidmatan anda untuk mengemaskini atau untuk membetulkan kesilapan sedemikian atau memaklumkan kami secara bertulis dengan segera melalui butir-butir perhubungan yang dinyatakan seperti berikut. Sunway akan menangani pertanyaan, permintaan dan/atau aduan anda secepat mana yang munasabah.
7. Subjek Data boleh pada bila-bila masa meminta untuk mengehadkan pemprosesan Data Peribadi Subjek Data, membetulkan Data Peribadi Subjek Data yang dipegang oleh Sunway atau memadam akaun Perkhidmatannya. Permintaan sedemikian harus dibuat secara bertulis melalui emel seperti yang dinyatakan di berikut. Subjek Data bersetuju bahawa walaupun permintaan tersebut, Sunway boleh terus memproses dan/atau mengekalkan Data Peribadi Subjek Data setakat yang diperlukan atau dibenarkan oleh undang-undang dan peraturan yang berkenaan.

8. Pelanggan bersetuju bahawa Polisi Peribadi ini akan membentuk sebahagian Terma-terma dan Syarat-syarat bagi Perkhidmatan tersebut ("Syarat-syarat" tersebut) dan persetujuan Syarat-syarat tersebut akan membentuk persetujuan kepada Polisi Keperibadian ini.
9. Pelanggan tersebut akan dianggap telah mendapatkan persetujuan mana-mana individu pihak ketiga yang mana Data Peribadinya telah dibekalkan kepada Sunway oleh Pelanggan tersebut untuk Tujuan dan/atau Perkhidmatan tersebut, mana-mana yang terpakai, kepada pemprosesan Data Peribadi Sunway berdasarkan Polisi Keperibadian ini. Sekiranya Pelanggan tersebut bukannya suatu entiti individu, Data Peribadi tersebut yang dibekalkan kepada Sunway oleh Pelanggan tersebut untuk Tujuan dan/atau Perkhidmatan tersebut, akan dianggap sebagai telah dibekalkan secara sah di mana persetujuan bagi pemprosesan Data Peribadi tersebut oleh Sunway berdasarkan Polisi Keperibadian ini telah dibekalkan oleh Subjek Data yang berkenaan melalui Pelanggan tersebut.

Versi Bahasa Inggeris akan berkuatkuasa sekiranya terdapatnya apa-apa percanggahan dengan versi Bahasa Melayu.
